(1)《中华人民共和国教师法》第三十九条规定,教师对学校或者其他教育机构侵犯其合法权益的,或者对学校或者其他教育机构作出的处理不服的,可以向教育行政部门提出申诉,教育行政部门应当在接到申诉的三十日内,作出处理。
《中华人民共和国教师法》第三十七条规定,教师有下列情形之一的,由所在学校、其他教育机构或者教育行政部门给予行政处分或者解聘。
(一)故意不完成教育教学任务给教育教学工作造成损失的;
(二)体罚学生,经教育不改的;
(三)品行不良、侮辱学生,影响恶劣的。
教师有前款第(二)项、第(三)项所列情形之一,情节严重,构成犯罪的,依法追究刑事责任。
